Today at the Court of Appeals (4/11/11)

Today, a panel of the North Carolina Court of Appeals comprised of Chief Judge Martin and Judges Elmore and Geer will hear oral argument in State v. Hayden.  The appeal involves a challenge to the Defendant's conviction on the charge of first degree murder.  The Defendant contends that (1) the trial court should have granted the Defendant's motion to dismiss the murder charge and vacate his conviction because the state failed to present evidence beyond a mere suspicion that the Defendant was the perpetrator; (2) the trial court improperly admitted hearsay statements; and (3) that the trial court improperly admitted character evidence.
